Enforcement

Although Guam has a statewide Tobacco Retail License fee of $100, it is not designated to fund enforcement. Guam’s Department of Revenue and Taxations in conjunction with the Behavioral Health and Wellness Center are the designated enforcement agencies with penalties placed on the retailer. With decoys to be ages 12-17 and no mandated minimum number of annual compliance checks, there’s a risk of poor retailer compliance. However, the 5-year violation accrual period and penalty structure is strong.

Preemption

All public health is local. Often Big Tobacco works to add preemption to statewide tobacco control bills so cities and counties are unable to enact laws that better protect the public.
