Enforcement

Although Indiana’s Tobacco Retail License fee is $300, it only renews every three years and not annually which isn’t adequate to fund enforcement. The Indiana State Excise Police is the designated enforcement agency with penalties placed on the retailer, clerk, and “Person.” Compliance checks are conducted once a year per retailer; however, the penalty structure does not include suspension of license and revocation is mandatory after a 6th violation within one year.

Preemption

All public health is local. Often Big Tobacco works to add preemption to statewide tobacco control bills so cities and counties are unable to enact laws that better protect the public.
