Enforcement
New Mexico has a comprehensive statewide Tobacco Retail License with a fee not to exceed $750 per retailer; however, the fee is designated to only partially fund enforcement. The Department of Public Safety oversees enforcement with ID check required for all in-person purchases of tobacco products. Unfortunately, compliance checks are done at random with no minimum per retailer annually and there isn’t a strong penalty structure in place for repeat offenders to hold retailers accountable for underage sales of tobacco products.

All public health is local. Often Big Tobacco works to add preemption to statewide tobacco control bills so cities and counties are unable to enact laws that better protect the public.
